Terms of Use

Effective date: September 24, 2026

These Terms of Use (“Terms”) govern access to and use of traditionstradingpost.com and the Traditions Trading Post marketplace (“Traditions,” “we,” “us,” or “our”). By accessing the site, creating an account, applying to sell, listing goods, or purchasing through the marketplace, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site.

1. Marketplace status

Traditions provides an online marketplace where independent sellers may offer physical goods to customers. Unless a product listing expressly states otherwise, Traditions is not the manufacturer, owner, or seller of goods listed by independent sellers and is not a party to the direct sales contract between a buyer and seller. Sellers control their products, pricing, inventory, descriptions, fulfillment, shipping, and customer communication, subject to these Terms and marketplace policies.

The marketplace is currently being prepared for public launch. Pre-launch information, seller applications, projected features, fees, availability, and timelines may change before customer purchasing is enabled.

2. Eligibility and accounts

You must be at least 18 years old and legally able to enter a binding agreement to create an account, apply as a seller, or make a purchase. You agree to provide accurate, current information and to keep account credentials secure. You are responsible for activity conducted through your account and must notify us promptly of suspected unauthorized use.

Seller accounts and storefronts require approval. Submitting an application does not guarantee acceptance, traffic, promotion, sales, or income. We may approve, deny, suspend, restrict, or terminate accounts when reasonably necessary to protect users, enforce these Terms, comply with law, or preserve the integrity of the marketplace.

3. Seller responsibilities

Each seller is solely responsible for:

  • Ensuring products, listings, claims, materials, production methods, and business practices comply with applicable laws and regulations.
  • Providing truthful descriptions, original or properly licensed photographs, accurate prices, availability, processing times, shipping terms, and shop policies.
  • Having the rights, licenses, permits, and authorizations necessary to make, market, and sell listed products.
  • Safely packaging and timely fulfilling orders, communicating with customers, and addressing returns, refunds, defects, losses, and delivery problems under applicable law and marketplace policies.
  • Collecting, reporting, and paying taxes, duties, fees, and other obligations for which the seller is legally responsible.
  • Protecting customer information and using it only to complete transactions, provide support, meet legal obligations, or as otherwise authorized.

Sellers may not list unlawful, unsafe, counterfeit, stolen, fraudulent, misleading, infringing, recalled, or otherwise prohibited goods. Traditions may remove listings or restrict accounts when we reasonably believe content or conduct violates these Terms, marketplace policies, third-party rights, or applicable law.

4. Fees and payment processing

Approved Founding Sellers are currently offered a 3% Traditions marketplace transaction fee for their first 12 months. The currently proposed standard marketplace transaction fee after that period is 5%. The 3% rate is temporary and is not a lifetime or permanently guaranteed rate. Standard payment-processing fees apply separately. There are currently no listing fees or required monthly seller subscriptions.

Final payment, payout, reserve, refund, dispute, and chargeback procedures will depend on the payment system selected before marketplace launch. Applicable charges and procedures will be disclosed before sellers are required to process live transactions. We may change fees prospectively by providing reasonable notice as required by law.

5. Orders, shipping, returns, and disputes

When customer purchasing is enabled, an order may be subject to seller acceptance, payment authorization, inventory availability, fraud review, and other reasonable checks. Sellers are responsible for fulfillment and shipping. Products from different sellers may ship separately.

Returns, refunds, cancellations, damaged items, and delivery disputes will be governed by applicable law, the listing, the seller’s disclosed policies, and marketplace-wide policies in effect at the time of purchase. Traditions may facilitate communications or issue marketplace-level decisions where appropriate but does not guarantee that every dispute will be resolved to either party’s satisfaction.

6. Chargebacks and amounts owed

Sellers are responsible for losses, refunds, chargebacks, reversals, payment disputes, penalties, and related costs arising from their products, listings, fulfillment, conduct, or transactions, except to the extent caused solely by Traditions’ own error or where applicable law requires otherwise. Traditions may recover amounts owed from available seller balances or future payouts, or request repayment, subject to applicable law and the payment provider’s rules.

7. Acceptable use

You may not misuse the site; interfere with its operation or security; attempt unauthorized access; introduce malicious code; scrape or copy the site in violation of law; impersonate others; submit false information; manipulate reviews or transactions; evade fees; harass users; or use the marketplace for fraud, unlawful activity, or infringement.

8. Intellectual property

The Traditions Trading Post name, logo, site design, and original site content are owned by or licensed to Traditions and may not be used without permission. Sellers and users retain ownership of content they submit, but grant Traditions a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, and promote that content as reasonably necessary to operate and market the marketplace. You represent that you have the rights needed to grant this license.

9. Third-party services

The site may use or link to hosting, payment, shipping, email, security, analytics, or other third-party services. Those services operate under their own terms and privacy practices. Traditions is not responsible for third-party services beyond obligations that cannot legally be excluded.

10. Disclaimers

To the fullest extent permitted by law, the site and marketplace are provided “as is” and “as available.” Traditions does not guarantee uninterrupted operation, particular sales results, buyer traffic, product quality, seller performance, or the accuracy of user-provided content. Nothing in these Terms excludes warranties, duties, or rights that cannot lawfully be excluded.

11. Limitation of liability

To the fullest extent permitted by law, Traditions and its owner, operators, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, business interruption, or losses arising from transactions between independent buyers and sellers. Traditions’ aggregate liability arising from the service will not exceed the greater of amounts you paid directly to Traditions during the six months before the claim or $100. This limitation does not apply where liability cannot legally be limited.

12. Indemnification

To the fullest extent permitted by law, sellers agree to defend, indemnify, and hold harmless Traditions and its owner, operators, affiliates, and service providers from third-party claims, losses, liabilities, damages, judgments, and reasonable costs arising from the seller’s products, listings, conduct, legal violations, intellectual-property infringement, fulfillment, taxes, or breach of these Terms.

13. Suspension and termination

You may stop using the site at any time. Traditions may suspend or terminate access, remove content, hold transactions for review, or take other reasonable action for violations, suspected fraud, security risks, legal requirements, nonpayment, or conduct that threatens users or the marketplace. Provisions that by their nature should survive termination will remain effective.

14. Governing law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute not required by applicable law to be heard elsewhere will be brought in a state or federal court with jurisdiction in Michigan, and the parties consent to that jurisdiction and venue.

15. Changes to these Terms

We may update these Terms as the marketplace develops, services change, or legal requirements evolve. The effective date will be revised when changes are posted. Material changes may also be communicated through the site or by email. Continued use after revised Terms take effect constitutes acceptance to the extent permitted by law.

16. General terms

If any provision is found unenforceable, the remaining provisions will continue in effect. Failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our consent; Traditions may assign these Terms in connection with a business transfer or reorganization. These Terms, the Privacy Policy, and applicable marketplace policies constitute the agreement governing use of the service.
